RIGHT OF ENTRY <br /> <br />CLIENT will provide for the right of entry for WMCI, its subcontractors, and all! necessary equipment in <br />order to complete the SERVICES under this Agreement. <br /> <br />12. CONTROL OF WORK <br /> <br />WMCI shall be responsible only for its activities and that of its employees and: subcontlactors. WMCI's <br />SERVICES under this Agreement are performed for the sole benefit of the CLlSNT and no other entity or <br />person shall have any claim against WMCI because of this Agreement, or the performance or <br />. nonperformance of SERVICES hereunder, unless such claim is related to the negligent acts, willful <br />misconduct, errors or omissions of WMCI, its employees, consultants, s4bcontractors, officers or <br />directors. <br /> <br />. I <br />Insofar as job site safety is concerned, WMCI is responsible only for the! health and safety of its <br />employees and subcontractors. Nothing herein shall be construed to relie~e CLIENT or any other <br />consultants or contractors from their responsibilities for maintaining a safe job ~ite. <br /> <br />13. COMPLIANCE WITH CODES AND STANDARDS <br /> <br />WMCI's professional SERVICES shall be consistent with the Standard of C~re and shall incorporate <br />those publicly known Federal, State and local laws, regulations, codes and stahdards that are applicable <br />at the time WMCI rendered its services. <br /> <br />14. NOTICES <br /> <br />All notices required or permitted to be given hereunder shall be deemed to be properly given if delivered in <br />writing. by hand, sent by facsimile machine or deposited in the United States mail (or with an express <br />courier) addressed to CLIENT or WMCI, as the case may be, at the adqress 9;)t forth below, with <br />postage thereon fully prepaid. <br /> <br />All notices, correspondence, deliverables, and invoices shall be submitted to C,LIENT as indicated below: <br />I <br /> <br />Orchard Mesa Irrigation District <br />P.O.
