The County will make every effort to maintain communication <br />with the property owner as the project is implemented. <br /> <br />Other Institutional Arrangements <br /> <br />Construction of the project will require execution of agreements between the County and the <br />Larimer -Weld Ditch Company, as well as amendment of City of Fort Collins - Larimer County <br />IGA. It will also require permits from the US Army Corps of Engineers and the Colorado <br />Department of Health. Finally, the Project will require approval ofthe Federal Emergency <br />Management Agency (FEMA) as evidenced by a Conditional Letter of Map Revision (CLOMR). <br /> <br />Larimer-Weld Ditch Company <br /> <br />The URS Plan has been reviewed by the Larimer-Weld Irrigation Company and their <br />engineering consultant, Mr. John Andrew, PhD of Water Management Consultants, Denver, <br />Colorado. The Irrigation Company has approved the plan in concept as evidenced by a letter <br />from Mr. Mayo Sommerrneyer, legal counsel to Larimer-Weld Irrigation Company, Appendix <br />111. <br /> <br />The general intent of discussions among Larimer County, the City of Fort Collins and the <br />Larimer- Weld Irrigation Company has been that the irrigation company will authorize the use of <br />their facilities for stormwater storage and transport, provided that the City and County agree to <br />maintain the facilities and assist the Company in transporting water along Dry Creek from <br />Douglas Reservoir for delivery into the Larimer -Weld Canal. This conceptual arrangement will <br />be drawn into a formal agreement between Larimer County and the Larimer-Weld Irrigation <br />Company. <br /> <br />It is anticipated that the City of Fort Collins, with funding from Larimer County will become <br />responsible for maintenance of the L- W Canal along the section used for transport of floodwater <br />with construction of the Project. The irrigation company has in recent years become increasingly <br />responsible for stormwater runoff originating in developed areas upstream of the canal. The City <br />is more capable of addressing urban stormwater operational needs than the irrigation company. <br /> <br />Larimer County and the State of Colorado <br /> <br />A contract will be entered into between Larimer County and the State of Colorado for the <br />purpose of defining the terms and conditions for the loan, and the requirements for its repayment. <br />The County will commit to using its full authority to enforce payment of service fees for the Dry <br />Creek Stormwater Utility, and the County will pledge that the West Vine Stormwater Utility will <br />place debt service on the CWCB loan above all other commitments and expenditures of the <br />utility. <br /> <br /> <br />Federal Emergency Management Agency (FEMA) <br /> <br />The Dry Creek floodplain encompasses some 1,000 acres in the Fort Collins urban area. In <br />accord with FEMA requirements, properties within the area must meet floodplain regulations of <br /> <br />18 <br />
