Water storage rights were decreed in
Fossil Creek Reservoir in Civil Action No. 1591 by the District Court, Larimer County, State of
Colorado, on December 9, 1904 and in Case Nos. 2031 and 11217 by the District Court,
Larimer County, State of Colorado, on April 22, 1922 and September 10, 1953, respectively.
Fossil Creek Reservoir stores water tributary to the Cache la Poudre River and is located in
Section 10, T6N, R68W, 6th P.M. (immediately west of 1-25 between Loveland and Fort Collins.)
Storage right appropriation dates and amounts are as shown in the following table:

Adjudication Date

Appropriation Date

Amount (ac-ft)

A ril 22, 1922
Se tember 10, 1953
Se tember 10, 1953
September 10,,1953

March 5, 1901
March 5, 1901
June 1, 1904
June 1, 1904

The GIC receives about 1300-1400 acre feet annually from Fossil Creek Reservoir. Combined
delivery from direct flow diversions and Fossil Creek Reservoir storage is estimated to be about
18,000 AF. Historical average annual consumptive use of GIC water is 5,358 acre-feet, or
10.31 AF per share.

Proiect Description

Elements of the proposed project were developed in a series of work sessions with the GIC
Soard of Directors. Several aspects of the improvements are under continued discussion and
final recommendations and detailed designs, when appropriate, will not be made until the
engineering work is initiated following CWCS loan approval.

, 1. River Diversion Improvements - A key component of the anticipated improvements is the
repair and partial replacement of GIC's diversion on the Cache la Poudre River. The
existing diversion structure shows signs of concrete deterioration, one of the three gates
is stuck in a closed position, and the silt gate is not adequate. Last year, a crane had to
be mobilized to the river diversion in order to remove a large tree trunk that was lodged
on the upstream side of the structure. The weir across the river is considered to be in

30f6
