<br />7. <br /> <br />Water Supply Reserve Account - Grant Application Form <br />Form Revised October 2006 I <br />I <br /> <br />Water Availability and Sustainability - this infonnation is heeded to assess the viability and <br />I <br />effectiveness of the water project or activity. Please provide a description of each water supply source <br />to be utilized for, or the water body to be affected by, the Jater activity. For water supply sources <br />being utilized, describe its location, yield, extent of development, and water right status. For water <br />bodies being affected, describe its location, extent of develbpment, and the expected effect of the water <br />I <br />activity on the water body, in either case, the analysis should take into consideration a reasonable <br />range of hydrologic variation. Attach additional sheets as !needed. <br />I <br /> <br /> <br />This particular water project involves the applicant's I Municipal Water System No.2, Town of <br />Silver Cliff, adjudicated by Decree of the District Water Court dated September 29, 1972 in Case <br />W-551 for 1.0 cfs of water with an appropriation date lof June 27, 1969, located in Custer County <br />at a point in a seepage area in the SW Y4 SW Y4 Sectiort 20, Township 22 South, Range 72 West of <br />the 6th Principal Meridian, at a point whence the northwest corner of said Section 20 bears N 03 <br />deg 24 min 13 sec W a distance of 4774.30 feet. i <br /> <br />This is a conditional decree most recently confirmed in Case Number 02CW68 by decree on <br />March 5, 2003 in District Court, Water Division 2'11 Colorado. The decree in Case 02CW68 <br />extended the conditional water right to March 2009. <br /> <br />Although this is a junior appropriation, the District tb.s received judicial approval of a plan for <br />augmentation to allow diversions at this location. A fihal decree was entered November 28, 2006, <br />in Water Case 02CWl86 by Dennis Maes, Water Jddge, District Court Water Division No.2, <br />Colorado, in which approval was granted for chang6s of water rights historically used out of <br />Macey Creek on the Johnson Place located in Custer :County, Colorado about six miles south of <br />Westcliffe. In Case 02CW186, the applicant's Municipal Water System No 2, Town of Silver <br />I <br />Cliff, became an alternate point of diversion for senior water rights out of Macey Creek with <br />appropriation dates ranging from May 15, 1872 to JunJ 10, 1888. <br />I <br /> <br />Out-of-priority depletions at Municipal Water Systek No.2 may now be replaced by direct <br />stream releases from the Johnson Place or by release~ from the existing DeWeese Reservoir or <br />I <br />from the Benoni Jarvis Reservoir (yet to be constructe1). <br /> <br />i <br />The applicant's Municipal Water System No.2 was originally developed by constructing an <br />underground collection pipe 12 inches in diameter, bUried approximately 15 feet deep, having a <br />gradient of 0.001 feet per foot and a length of 496 feet. Since then a water pipeline easement has <br />been secured from the decreed point of diversion to th~ existing District water distribution system <br />in Silver Cliff, Colorado. An alternate pipeline routei from the decreed point of diversion to the <br />existing distribution system in Westcliffe is also availkble via the road rights of way through the <br />recently approved Shining Mountain Subdivision. I <br />I <br />I <br />The next phase of improvement, and the putpose of ~is grant application, is to further develop <br />this water source by securing an electrical supply, obtaining a well permit, and constructing a <br />I <br />production well with building, pump, and treatment.
