(1) the diversion IS the subject of a deeree en-
tered before the date of the enactment of this Ad,

for whieh no new infrastructure or legal approvals

are necessarv to divert the water out of the natural

basin of the Colorado River;

(3) the diversion is the subject of an agreement

22 provides compensatory storage or alternate ,vater
