These ftirnds have not been distributed. The <br />Company has elected to decline presenting it caSe in court this year, given strong objectors <br />and the lack of senior water in its augmentation ~lan. The Sub district has 650 member~ with 966 junior wells and has operated <br />I <br />an augmentation plan for these members since ~973. On December 17, 2001, the <br />Colorado Supreme Court issued a judgment th~t changed the manner of operation for <br />substitute supply plans in Colorado. The rulini stated that the State Engineer did not <br />have the legal authority to approve substitute sVpply plans. The Court also stated that <br />substitute supply plans, such as the one operate1d by CCWCD would either have to file <br />for a decree in Water Court or follow new Rules and Regulations to be issued by the <br />I <br />State Engineer. This ruling has required CCW(ID to acquire more senior water rights as <br />I <br />well as build additional storage to augment outiof-priority diversions. CCWCD is in <br />the process of acquiring additional senior water I rights. To-date the District has been <br />approved for 3-separate loans, $15,000,000, $5,090,000, and $20,000,000. The $20,000,000 <br />loan was recently approved at the November 2004 Board Meeting, for a total project loan <br />authorization of $40,000,000. The $15,000,000 aitd $5,000,000 were substantially <br />completed in June of 2005. Central has completJd efforts for the GMS Sub-district and <br />are currently working on improvements to the WAS Sub-district. The WAS project is <br />approximately 85% complete.
