Bureau of Reclamation oppose the amendment. To date, the Staff has expressed concern over this
amendment because it has the potential to overturn the entire applecart, Moreover, the Staffhas
expressed concern that this legislation allows Congress to interfere with a U.S. Supreme Court
equitable apportionment decree. In the Staffs opinion this matter should be handled solely within
Wyoming, and under Wyoming water law. Joe Glode submitted written responses to questions
posed at the Senate Subcommittee hearing, and his attorneys have requested that the State of
Colorado not oppose the amendment.

Implementation

The Governance Committee has begun implementation of the Program, Recently, the Governance
Committee chose Dr. Jerry Kenny, ofHDR in Colorado, to be the executive director of the Program.
The Governance Committee is also implementing various aspects of the Program through contracts
with firms and through the various committees,

With regard to implementation of Colorado's Program, SPWRAP and the State have been working
through a number of issues about how to provide coverage, whether water users should be required
to sign recovery agreements, and under what circumstances is SPWRAP membership required to
take advantage of the Program.
