<br />Town of Minturn - Bolts Lake Dam and Ditch Rehab. <br /> <br />In January 1996, the Board approved a loan of $360,000 at 5.25 percent for 30 years to <br />the Town ofMintum for the purchase and rehabilitation of Bolts Lake for use as a <br />municipal raw water reservoir. The loan was subsequently authorized in SB 96-153. <br /> <br />The project involves the acquisition of 150 acres of land, ditch and headgate repairs, <br />raising an existing dam embankment and a new spillway at an estimated cost of $470,000 <br />in 1995. <br /> <br />The Town has recently been involved in water rights litigation for both the Town's direct <br />flow right on Cross Creek as well as the storage right for Bolts Lake. Please see the <br />attached letter from Alan Lanning, the Town Manager. In addition, unforeseen problems <br />have been encountered in attempting to acquire the property on which the reservoir is <br />located. The Town is, however, hopeful that the property owners may eventually be <br />willing to donate the land for the project. <br /> <br />The Town is requesting that the project not be deauthorized in view of the additional <br />expenses incurred in the last few years for water rights litigation and the unforeseen <br />problems encountered with property acquisition. Staff recommends that the Bolts Lake <br />project, as authorized in HB 96-153, not be deauthorized and that the Board and the staff <br />review the status of the project again in one year. It is expected that the feasibility study <br />for the project will be updated before entering into a loan contract with the Town. <br />
