Town of Minturn - Bolts Lake Dam and Ditch Rehab.

In January 1996, the Board approved a loan of $360,000 at 5.25 percent for 30 years to
the Town ofMintum for the purchase and rehabilitation of Bolts Lake for use as a
municipal raw water reservoir. The loan was subsequently authorized in SB 96-153.

The project involves the acquisition of 150 acres of land, ditch and headgate repairs,
raising an existing dam embankment and a new spillway at an estimated cost of $470,000
in 1995.

The Town has recently been involved in water rights litigation for both the Town's direct
flow right on Cross Creek as well as the storage right for Bolts Lake. Please see the
attached letter from Alan Lanning, the Town Manager. In addition, unforeseen problems
have been encountered in attempting to acquire the property on which the reservoir is
located. The Town is, however, hopeful that the property owners may eventually be
willing to donate the land for the project.

The Town is requesting that the project not be deauthorized in view of the additional
expenses incurred in the last few years for water rights litigation and the unforeseen
problems encountered with property acquisition. Staff recommends that the Bolts Lake
project, as authorized in HB 96-153, not be deauthorized and that the Board and the staff
review the status of the project again in one year. It is expected that the feasibility study
for the project will be updated before entering into a loan contract with the Town.
