Box 1120, Glenwood Springs, Colorado 81602 <br /> <br />hereinafter referred to as the contractor, <br /> <br />WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise made available and <br />a sufficient unencumbered balance thereof remains availabJr.f9~.!!Y;OJ:.nt in Fund Number 4008 , G/L Account <br />Number 5291X , Contract Encumbrance Number~~~~; and <br />ABL Number 12910, Org. Unit Number 77-77-777. <br />WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate <br />agencies; and <br /> <br />WHEREAS. pursuant to the provisions of section <br />37-60-122(1)(c). Colorado Revised Statutes. as amended. the <br />State is authorized to prepare feasibility reports on proposed <br />water projects; and <br /> <br />WHEREAS. the Contractor was created pursuant to the <br />provisions of section 37-46-103. Colorado Revised Statutes; and <br /> <br />WHEREAS. the Contractor is authorized pursuant to the <br />provisions of section 37-46-149 to accept contributions. <br />grants. or loans from the State; and <br /> <br />WHEREAS. the State. acting through the Colorado Water <br />Conservation Board (CWCB). has determined that it will support <br />the conduct of a feasibility study on the reformulation of the <br />Contractor's proposed Juniper Cross Mountain Project to be <br />performed; and <br /> <br />WHEREAS. the Contractor desires to share in the cost of the <br />said feasibility study and to perform the said study in <br />cooperation with the State and the Recovery Implementation <br />Program (RIP) for Endangered Fish Species in the Upper Colorado <br />River Basin; and <br /> <br />WHEREAS. a Memorandum of Understanding defining the terms <br />and conditions for conducting the said feasibility study has <br />been executed by the Contractor. the State. the RIP. and the <br />U.S. Bureau of Reclamation. which Memorandum of Understanding <br />is attached hereto as Appendix A and by this reference made a <br />part of this contract; and <br /> <br />1620E* <br /> <br />395-53-01-1014 <br /> <br />Page I of ~ pages <br />*(See instructions on reverse of last page) <br />
