(Water Conservation Board)
hereinafter referred to as the State, and '2 Colorado River Water Conservation District

hereinafter referred to as the contractor,

WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise made available and
a sufficient unencumbered balance thereof remains availab~Jm;t in Fund Number 4008 , G/L Account
Number 5291X ,Contract Encumbrance Number ~; and
ABL Number 12910, Org. Unit Number 77-77-777.
WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate
agencies; and

WHEREAS. pursuant to the provisions of section
37-60-122(1)(c). Colorado Revised Statutes. as amended. the
State is authorized to prepare feasib~lity reports on proposed
water projects; and

WHEREAS. the Contractor was created pursuant to the
provisions of section 37-46-103. Colorado Revised Statutes; and

WHEREAS. the Contractor is authorized pursuant to the
provisions of section 37-46-149 to accept contributions.
grants. or loans from the State: and

WHEREAS. the State. acting through the Colorado Water
Conservation Board (CWCB). has determined that it will support
the conduct of a feasibility study on the reformulation of the
Contractor1s proposed Juniper Cross Mountain Project to be
performed; and

WHEREAS. the Contractor desires to share in the cost of the
said feasibility study and to perform the said study in
cooperation with the State and the Recovery Implementation
Program (RIP) for Endangered Fish Species in the Upper Colorado
River Basin; and

WHEREAS. a Memorandum of Understanding defining the terms
and conditions for conducting the said feasibility study has
been executed by the Contractor. the State. the RIP. and the
U.S. Bureau of Reclamation. which Memorandum of Understanding
is attached hereto as Appendix A and by this reference made a
part of this contract: and
