Document Release

Dear Mr. Greer:

This refers to Feasibility Report Contract No. C153686, dated January 24, 1995, between The
Red Mesa Ward Reservoir and Ditch Company and the Colorado Water Conservation Board. Referring
to Section 6b of the Repayment Provisions to this agreement, the loan will be forgiven if the project is not
feasible and is not built. Since the project has been determined to be not feasible and will not be built,
repayment of this loan has been forgiven. Therefore, the attached documents are being returned to you to
terminate this agreement; detail as follows:

1. The original agreement stamped "VOID" to signify its termination;
2. The original released Deed of Trust cancelled by the Public Trustee of La Plata County; and
3. A copy of the request for Release of Deed of Trust and Release.
