<br />a. The second sentence of Paragraph A.1, Time for Project Completion, shall be <br />amended to read as follows: 'Therefore, the Borrower shall finalize the Project <br />water rights purchases within four (4) years of the date of this contract." <br /> <br />b. The first two sentences of the second paragraph of Paragraph A.3, BORROWER'S <br />Liability Insurance, are amended to read as follows: 'The BORROWER shall provide <br />the CWCB with an Acord Form 27 evidencing said insurance and shall provide the <br />CWCB with documentation of renewals of said insurance." . <br /> <br />c. Line 5 of Paragraph A.4.e, BORROWER'S Authority to Contract, is revised to remove <br />the requirement for an Assignment of Deposit Account as Security, and is <br />amended to read as follows: "a Security Agreement to secure the revenues <br />pledged. . ." <br /> <br />d. Paragraph A.6, Promissory Note Provisions shall be amended to read as follows: <br />"The Promissory Note, setting forth the terms of repayment and evidencing this <br />loan is dated February 1, 2003, in the total loan amount of $399,000, with an <br />interest rate of 4.75% per annum on $305,250 and an interest rate of 5.5% on <br />$93,750, and a repayment term of 30 years, is attached as Appendix 2 and <br />incorporated herein. <br /> <br />e. The second line of Paragraph A.6.a, Interest During Construction, shall be <br />amended to read as follows: "the BORROWER during PROJECT completion, interest <br />shall accrue at the rate of 4.75% on the first $305,250 disbursed to the BORROWER <br />and at the rate of 5.5% on the remaining $93,750 disbursed to the BORROWER. <br />The amountofthe interest ..." <br /> <br />f. Line 4 of Paragraph A.9.b, Estab.lish Security Interest, shall be revised to remove <br />the requirement for an Assignment of Deposit Account as Security, and shall be <br />amended to read as follows: "hereto as Appendix D incorporated herein. The <br />BORROWER acknowledges that. . ." <br /> <br />g. The first line of Paragraph B.1 shall be amended to read as follows: 'The CWCB <br />agrees to loan to the BORROWER up to $399,000 with an interest rate of 4.75% <br />per annum on $305,250 and an interest rate of 5.5% on $93,750 and a <br />repayment term of 30 years to finance PROJECT costs." <br /> <br />8. Except for the SPECIAL PROVISIONS, in the event of any conflict, inconsistency, <br />variance, or contradiction between the provisions of this Amendment and any of the <br />provisions of the ORIGINAL CONTRACT, as amended, the provisions of this Amendment <br />shall in all respects supercede, govern, and control. The SPECIAL PROVISIONS shall <br />always be controlling over other provisions in the contract or amendments. The <br />representations in the SPECIAL PROVISIONS concerning the absence of bribery or <br />corrupt influences and personal interest of STATE employees are presently reaffirmed. <br /> <br />9. Financial obligations of the state payable after the current fiscal year are contingent <br />upon funds for that purpose being appropriated, budgeted, and otherwise made <br />available. <br /> <br />10.
