CONTRACT

THIS CONTRACT, made this 19th day of July 197j, by and between the
State of Colorado for the use and benefit of the Department of'l Natural Resources,
Colorado Water Conservation Board

hereinafter referred to as the contractor,

WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise ade
available and a sufficient unencumbered balance thereof remains ava~ for payment in Fund Number 1001
G/L Account Number 5195:", /Contract. Encumbrance NumberC I &..U", ; and

WHEREAS, required approval, clearance and coordination has been accomplished from and with approp iate
agencies; and

WHEREAS, '3 pursuant to the provisions of 149-1-22, Colorado R
statutes 1963, as amended, the ColoradO Water Conservation Boa
authorized to construct certain water projects for the benefit
the people of the state of Colorado; and

WHEREAS, the city of Delta has made application to the Boar
the investigation of a water project for the purpose of supply'
additional municipal and industrial water to the inhabitants 0
areas served by the applicant; and

WHEREAS, the Contractor is a professional engineering firm
the state of Colorado, and has previously done considerable
related work for various municipalities in Colorado;

NOW THEREFORE, it is hereby agreed that

1. '4 The Contractor agrees to prepare a feasibility report
would compare development of additional water supplies on Grand
through transfer of irrigation water rights with the costs of
constructing, operating, and maintaining raw water storage.trea
and transmission facilities for development of water rights in
Gunnison River owned by the City of Delta, in accordance with a
proposal dated July 9, 1974, for a project feasibility report
prepared by the Contractor and approved by the Colorado Water
Conservation Board. Said proposal is attached hereto as Exhibi
and made part of this contract.
2. Thirty (30) copies of the report called for in this
contract shall be furnished to the state not later than Decembe
1974, unless such time is extended by mutual agreement of the p
hereto.
3. As compensation for the services of the Contractor, t e
State agrees to pay to the. Contractor the sum of Nine Thousand
Dollars ($9,000) in the manner following:
