From Lake Granby, C-BT Project water is pumped first into Shadow Mountain <br />Reservoir and then flows by gravity into Grand Lake. At Grand Lake, the water <br />flows by gravity beneath the Continental Divide tluough the Alva B. Adams <br />TUIUlel (the ""Adams Tunnel"). Once the water is delivered to the East Slope, it <br />is stored in several reservoirs and released to river systems where it is available <br />for use by owners of contractual commitments from the Project. The authorizing legislation for the C-BT Project requires that the C-BT Project <br />be constructed and operated in conformance with the requirements of Senate <br />Document 80. The complete title of Senate Document 80 is Synopsis of Report <br />on Colorado Big Thompson Project, Plan of Development and Cost Estimate <br />Prepared by the Bureau of Reclamation, Department of the Interior, 75th <br />Congress, First Session, June 15, 1937. The portion of Senate Document 80 <br />entitled "'Manner of Operation of Project Facilities and Auxiliary Features" <br />provides that the C-BT Project was to preserve ""the rights and interests <br />dependent on this water, which exist on both slopes of the Continental Divide in <br />Colorado." I d. at 2-3 (Excerpts from Senate Document 80 are attached as <br />Exhibit A). <br /> <br />6. The obligations imposed by Senate Document 80 have long been acknowledged <br />by Reclamation, as well as by this and other Courts. See, e.g., Reclamation's <br />Operating Policy for Green Mountain Reservoir (""The Bureau of Reclamation <br />has the responsibility to operate and maintain the C-BT Project in accordance <br />with the provisions of Senate Document 80.") 48 Fed. Reg. 56657 (Dec. 22, <br />1983); Public Service Co. of Colorado v. Federal Energy Regulatory Comm 'n, <br />754 F.2d 1555, 1561 (loth Cir. 1985). <br /> <br />6 <br />
