<br />. <br /> <br />. <br /> <br />. <br /> <br />The Secretary will deliver Colorado River water to contractors in a manner consistent with these <br />arrangements, provided, however, that any such arrangements are consistent with the BCPA, the <br />Decree and do not infringe on the rights of third part~s. Surplus water will only be delivered to <br />entities with contracts tOr surplll'i water. <br /> <br />3. Definitions <br /> <br />For purposes of these guidelines, the following definitions apply: <br /> <br />a. "Domestic" Uge shall have the meaning defined in the Compact <br /> <br />b. "Off-stream Banking" shall mean the diversion of Colorado River water to underground <br />storage facilities tOr use in subsequent years from the fucility used by a contractor <br />diverting such water. <br /> <br />c. "Direct De livery Domestic Use" shall mean direct delivery of water to domestic end <br />users or other munici[Xl1 and industrial water providers w~hin the contractor's area of <br />normal service, including incidental regulation of Colorado River water supplies within the <br />year of operation but not including Off-stream Banking. <br /> <br />d. "Direct Delivery Domestic Use" for The Metropolitan Water District of Southern <br />California (MWD) shall include delivery of water to end users within its area of normal <br />service, incidental regulation of Cobrado River water supplies within the year of <br />operation, and Off-stream Banking only w~h water delivered through the Colorado River <br />Aqueduct. <br /> <br />4. <br /> <br />Relationship with Existing Law <br /> <br />These Guidelines are rot intended to, and do not: <br /> <br />a. Guarantee or assure any water user a fum supply for any specifl:d period. <br /> <br />b. Change or expand existing authorities under applicable federal law, except as <br />specifically provided herein with respect to detenninations of surplus conditions under the <br />Long Range Operating Criteria and administration ofsurplus water supplies during the <br />effective period of thege Guidelines. <br /> <br />c. Address intrastate storage or intrastate distribution of water, except as may be <br />specifically proviled by Lower Division States and individual contractors for Colorado <br />River water who may adopt arrangements that will affect utilization of Colorado River <br />water during the effective period of these Guidelines. <br /> <br />d. Change the apportiomnents made for use within individual States, or in any way impair <br /> <br />18 <br />
