In addition, the Board's Rule 9.43 <br />provides that at a regularly scheduled meeting the Board may take final action to ratify, <br />refuse to ratify, or to ratify, with additional conditions, an injury with mitigation <br />proposal. Consequently, the Staff has included this item on the Board's agenda to <br />preserve the Board's ability to authorize the Staff to proceed to trial or to ratify an injury <br />with mitigation proposal with additional conditions. <br /> <br />A confidential memo is being provided, under separate cover, by Linda Bassi <br />who represents the Board in this case. This confidential memo spells out the various <br />possible interpretations of the stipulation and decree and explains the options available to <br />the Board. <br /> <br />Staff Recommendation <br />The Staff recommends that the Board instruct the Staff to take those actions <br />consistent with the directions provided by the Board during the executive session <br />discussion of this matter. Possible actions include, but are not limited to: 1) proceed to <br />trial; or 2) clarify or amend the mitigation plan. <br /> <br />2 <br />
