<br />(2) THE OFFICE SHALL DEVELOP PROGRAMS TO PROVIDE TECHNICAL <br />ASSISTANCE TO COVERED ENTITIES AND OTHER STATE OR LOCAL <br />GOVERNMENTAL ENTITIES IN THE DEVELOPMENT OF DROUGHT MITIGATION <br />PLANS. <br /> <br />(3) THE BOARD IS HEREBY AUTHORIZED TO RECOMMEND THE <br />APPROPRIATION AND EXPENDITURE OF SUCH REVENUES AS IS NECESSARY <br />FROM THE UNOBLIGATED BALANCE OF THE FIVE PERCENT SHARE OF THE <br />OPERATIONAL ACCOUNT OF THE SEVERANCE TAX TRUST FUND DESIGNATED <br />FOR USEBY THE BOARD FOR THE PURPOSE OF ASSISTING COVERED ENTITIES <br />AND OTHER STATE AND LOCAL GOVERNMENTAL ENTITIES TO DEVELOP <br />DROUGHT MITIGATION PLANS IDENTIFIED AS SUFFICIENT BY THE OFFICE. <br /> <br />(4) By JULY 1,2005, THE BOARD SHALL ADOPT GUIDELINES FOR THE <br />OFFICE TOUSEIN REVIEWING AND EVALUATING DROUGHT MITIGATION PLANS <br />SUBMITTED BY COVERED ENTITIES IN ACCORDANCE WITH THIS SECTION. THE <br />GUIDELINES SHALL DEFINE THE METHOD FOR SUBMITTING PLANS TO THE <br />OFFICE AND SHALL SPECIFY HOW THE OFFICE WILL PRIORITIZE THE <br />DISTRIBUTION OF MONEYS. <br /> <br />SECTION 5. Effective date. This act shall take effect at 12:01 <br />a.m. on the day following the expiration of the ninety-day period after final <br />adjournment of the general assembly that is allowed for submitting a <br />referendum petition pursuant to article V, section 1. (3) of the state <br />constitution (August 4, 2004, if adjournment sine die is on May 5, 2004); <br />except that, if a referendum petition is fIled against this act or an item, <br />section, or part of this act within such period, then the act, item, section, or <br /> <br />PAGE 10-HOUSE BILL 04-1365 <br />
