<br />. <br /> <br />. <br /> <br />. <br /> <br />Consent Agenda Item J.e <br />Case No. 5-06CW253: Application of Strategic Real Estate Group <br /> <br />Application Summary <br /> <br />This is an application for ground water rights, change of water rights, and approval of a plan for <br />augmentation near Silverthorne. Applicant seeks the following: <br />1. Ground water rights for up to 10 wells (total 500 gpm cond.) for domestic, irrigation, <br />livestock watering, fire protection, recreation, piscatorial and other uses incident to <br />residential development, with an appropriation date of June 27,2006. <br />2. Change of water rights associated with the Swanson Oro Grande Ditch and Heit Ranch <br />Reservoir to include domestic, irrigation, livestock watering, fire protection, recreation, <br />piscatorial and augmentation. Wells will be used as alternate points of diversion during the <br />irrigation season. A portion of these water rights will be used as a source of augmentation <br />water. <br />3. Approval of a plan for augmentation to augment out-of-priority depletions from the wells <br />for use in connection with a residential development to be located on the Heit Ranch. <br />Applicant proposes to use dry up credits for the irrigation months and reservoir releases for <br />the non-irrigation months. <br /> <br />CWCB Appropriations <br /> <br />CWCB StreamlLake Amount Approp. The Applicant's proposed plan for <br />augmentation may injure the Board's instream flow water rights on the Blue River by not replacing <br />out-of-priority depletions in time, place and amount. The Applicant's proposed plan for <br />augmentation must address delayed impacts from the proposed wells as well as impacts from the <br />termination of historical irrigation return flows resulting from the dry-up of historically irrigated <br />land. <br /> <br />Other Obiectors <br /> <br />The City of Colorado Springs, City and County of Denver, Grand Valley Water Users Association, <br />Orchard Mesa Irrigation District, Ute Water Conservancy District, Town of Dillon, State and <br />Division Engineers, Town of Silverthorne and United States of America - Bureau of Reclamation <br />also filed statements of opposition to this application. <br />
