Application Summary

This is an application for ground water rights and approval of a plan for augmentation in Park
County north of Hartsel. Applicant seeks the following:

1. Ground water rights for Rinekar Ridge Wells 1-5 for 100 gpm per well, conditional, for
municipal uses within a proposed development known as the Preserve at Hartsel Springs
Ranch. The claimed appropriation date for the wells is December 27,2006.
2. Approval of a plan for augmentation to replace out-of-priority depletions resulting from
ground water diversions. The source of augmentation water is Hock Hocking Mine, decreed
in Case No. W -1318 as nontributary developed water.

The Applicant's proposed plan for augmentation may injure the Board's instream flow water rights
on the Middle Fork South Platte River by not replacing out-of-priority depletions in time, place and
amount.

Sanitation District, Upper South Platte Water Conservancy District; The State and Division
