Again, staff would not use such a statute to require their removal, but it could be an <br />issue for you in the future with regard to other downstream water rights. <br /> <br />t Finally you had mentioned that you intend to drill one or more wells near your western property line <br />for a future home and would not want the ISF filing to prohibit you from doing so. With regard to a future <br />well, it is my understanding from discussions with the Division 3 Engineer's office that you may be able to <br />get a full exempt domestic well for household use and irrigation of up to 1 acre of lawn and garden. <br />However, In order to get a full domestic well certain conditions have to be met such as having at least 35 <br />acres and not being located in a subdivision. You would have to apply with the State Engineer's Office for <br />such a well. Since an exempt well is not administered within the priority system, the proposed ISF right <br />would not impact you. Furthermore, even if you were unable to get an exempt well, the ISF would not <br />preclude you from appropriating water (whether directly from Alder Creek or from a well) in the future. Such <br />an appropriation would simply be administerd within Colorado's water right system. <br /> <br />It is my hope that the above provisions and explanations will resolve your concerns. Again, I will personally <br />discuss each of your concerns with the Board, your proposed solution, and the alternative solution that I <br />have proposed of addressing the concerns through stipulated language. I will be interested in knowing <br />whether or not you feel that such language could work to resolve your concerns.
