Denver will pursue additional acquisitions in 1999. Downstream <br />storage is also the cornerstone of the above-mentioned commitment to provide <br />Non-potable Reuse Project water to the Rocky Mountain Arsenal. <br /> <br />Effluent Exchange Diligence. The City of Thornton, the Farmer's Reservoir and Irrigation <br />Company (FRlCO) have challenged Denver's use of Blue River effluent from the Bi-City <br />Wastewater Plant to effectuate exchanges. This challenge is being made in Case No. 96CWI45, <br />Water Division 1, which is Denver's diligence filing for exchanges to its South Platte River <br />diversion facilities in former Water District 8. Thornton and FRlCO claim the effluent does not <br />meet its requirements under C.R.S. ~37-80-120(3) or ~37-92-305(5). Deliver is vigorously <br />defending its rights to exchange reusable effluent. Trial is scheduled for three weeks beginning <br />April 26, 1999. <br /> <br />Denver Water also plans to expand its accounting methodology used to quantify reusable effluent <br />to include reusable effluent from the wastewater treatment plant owned by the City of Glendale, a <br />Denver Water distributor.
