Ms. Maryanne C. Bach
12/28/98
Page 5

000G71

acquisition of two of these sites representing a total potential storage of 8,000
acre- feet. Denver will pursue additional acquisitions in 1999. Downstream
storage is also the cornerstone of the above-mentioned commitment to provide
Non-potable Reuse Project water to the Rocky Mountain Arsenal.

Effluent Exchange Diligence. The City of Thornton, the Farmer's Reservoir and Irrigation
Company (FRlCO) have challenged Denver's use of Blue River effluent from the Bi-City
Wastewater Plant to effectuate exchanges. This challenge is being made in Case No. 96CWI45,
Water Division 1, which is Denver's diligence filing for exchanges to its South Platte River
diversion facilities in former Water District 8. Thornton and FRlCO claim the effluent does not
meet its requirements under C.R.S. ~37-80-120(3) or ~37-92-305(5). Deliver is vigorously
defending its rights to exchange reusable effluent. Trial is scheduled for three weeks beginning
April 26, 1999.

Denver Water also plans to expand its accounting methodology used to quantify reusable effluent
to include reusable effluent from the wastewater treatment plant owned by the City of Glendale, a
Denver Water distributor. This will increase the amount of reusable water available for
successive use.

Please contact Bob Peters of my staff should you have any questions regarding this report
(telephone: 303-628-6570, e-mail: rsp@water.denver.co.gov).

Sincerely,

02-L~~

-f: H.J.
