"We have a given set of rules we can predict today, and
that can change next year."

That's a line Stahoviak is not ready to buy.

"We don't think it needs to move this fast," Stahoviak said. "Maybe there is a
good reason, but I haven't heard it or seen it yet."

With the commissioners yet to talk to the city about the impacts of recreational
water rights, Monger also said the city's process was going way too fast.

"We need to move forward in collaboration, instead of (the city saying) 'we are
going to run the river and to hell with what everybody else has to say,'" Monger
said.

In October, the commissioners sent a letter to the city stating that they did not
agree with city staff's recommendation to move forward with obtaining new
water rights before any substantial discussion.

The city and county commissioners intended to meet last week to talk about
recreational water rights. But one of Porzak' first pieces of advice was to stop
communicating with other entities. He said in past cases, those discussions had
been used against his clients in court.

Stahoviak said she thought those talks need to occur before the city files for a
recreational water right, because once it does, it will mean court costs and legal
fees.

O'Donnell said that while the municipalities might work out their differences,
she fears it's the individual landowner who is going to lose.

"It is such a long, expensive process, at the end of the day, even if you do file
an opposition, the little guy will drop out because he won't be able to afford it,"
she said.

-- To reach Christine Metz call 871-4229

or e-mail cmetz@steamboatpilot.com

More in ~_ews

Copyright @ 2003 The Steamboat Pilot 8r.
