Form Revised October 2006

~
~
I

Water Supply Reserve ACCOUllIllt - Grant AppllncatioIDl Form

4. Please provide a brief narrative of any related or relevant previous studies. Attach additional
sheets as needed.

Clear Creek County has spent significant funds toward engineering, legal services, and purchase of senior
water rights for the Clear Creek County Water Banle.

Engineering assistance was provided by WRC Engineering, Inc. and Applegate Group, Inc. WRC work I
consisted of preliminary analyses on multiple reservoir sites in Clear Creele County including, but not ,-
limited to, the following: I

D . Clear Creele County Economic Development Corporation Reservoir Siting Analysis, WRC
Engineering, Inc., November 2002
D Draft Feasibility Study for Ball Placer Reservoir, Empire, Colorado, WRC Engineering, Inc. February
23, 2004.
D 3-Sheet Preliminary Plan Set accompanying the above feasibility report.
o Geotechnical Investigation by Kumar, included as an appendix to the feasibility report.
D Phase II Environmental Site Assessment, Proposed Ball Placer Dam and Reservoir, Empire, Colorado, I
Kumar & Associates, November 11,2003.
o . Douglas Mountain Ranch Geotechnical Report.
o United States Environmental Protection Agency, Letter from Robert L. Duprey, Director of the
Hazardous Waste Management Division, to Mr. Ed Rapp, Commissioner of Clear Creel( County with
excerpts from the CDH and EPA Record of Decision (ROD) on Empire Tailings, June 19,1995
o United States Environmental Protection Agency, Letter from Holly Fliniau, Project Manager, to Ms.
Theresa Jehn-Dellaport indicating that the Empire Tailings are not considered part of the Clear Creele
County/Central City Superfund Site, September 9, 1997.

The results of these previous studies project future water development demands and storage needs,
preliminary yield analyses and prefeasibility design on selected potential reservoir sites, including
perliminary estimates on construction and feasibility study costs. Additional research has been performed
on the Ball Placer site regarding feasibility and contaminants in the mine tailings located on site.

Applegate Group, Inc. performed a peer review of these studies and prepared a reconnaissance level study
that identified other potential reservoir sites within the County that warranted further evaluation and filing
for conditional water rights. This work met the standards for initiating conditional water rights and
included considerable data gathering. Field work and data analyses were provided as support services to
legal counsel for the preparation of a conditional water rights application. As a result, the County filed a
conditional water right application for storage for Grizzly Gulch Reservoir in Case No. 05CW303, which is
currently pending.

Applegate Group, Inc. also developed an engineering report to support the Clear Creek Basinwide Plan for
Augmentation in Case No.05CW302. The case is currently pending. A stipulation with Summit County
has already been reached and stipulations are currently being negotiated with other objectors.

n:\04143 .clear creek county ball placer reservoir\cwcb water supply reserve account grant\2006-2007 grant application form, 3.12.07 .doc

5
