Information concerning the proposed Agreement was presented by Scott <br />Balcomb and Jim Lochhead. <br /> <br />Action: <br /> <br />A motion was made by Tom Sharp and seconded by Eric Wilkinson to approve <br />the 7-State Agreement, to authorize Rod Kuharich in his capacity as the CWCB <br />Director to sign the Agreement, to recommend to the Governor of Colorado that <br />Scott Balcomb in his capacity as the Governor's representative in the <br />negotiations be authorized to sign the 7-State Agreement, both approvals subject <br />to the following three conditions: 1) satisfactory resolution of the Mexican Treaty <br />shortage negotiations; 2) agreement by the basin states on the preferred <br />alternative contained in the draft environmental impact statement (DEIS), being <br />prepared by the U.S. Department of the Interior - Bureau of Reclamation; and 3) <br />the satisfactory resolution of any other remaining issues that arise as the states <br />work through their comments on the DEIS and the actions the Lower Basin <br />States will have to undertake. <br /> <br />It was noted that the appropriate time for signing the 7-Basin State Agreement <br />will likely be shortly after February 28th when the draft DEIS is released. <br />However, comments on the DEIS are not due until approximately May 1, so <br />there is a possibility that the execution of the 7-State Agreement would be <br />delayed until that time. In the latter case, we would anticipate that the signed <br />agreement would be submitted together with an agreed upon set of comments <br />from the 7-Basin States on the DEIS. <br /> <br />A caution was noted that there may still be a few areas for negotiation before the <br />states present to Interior their "preferred alternative" and comments to the DEIS. <br />It is still possible that we might have a 7-State Agreement, but disagreement as to <br />what form the preferred alternative for river management might take. <br /> <br />A copy of the proposed Agreement is attached to the memorandum provided to <br />the Board. <br /> <br />The motion was approved unanimously (9-0). <br /> <br />Flood Protection.
