<br />J <br /> <br />\- <br /> <br />CONTRACT BETWEEN THE PURGATOIRE F <br />WATER CONSERVANCY DISTRICT AND <br />THE MODEL LAND AND IRRIGATION _ _ . <br /> <br />~~VED <br />JU~ <br />eoColorado Water <br />nservation Board <br /> <br />THIS CONTRACT, made and entered into as of this ;2 f~ <br />day of ~ ' l~~ , by and between the <br />PURGATOIRE RIVER WATER CONSERVANCY DISTRICT, a water con- <br /> <br />. servation district organized and existing within Las Animas <br />County under the laws of the State of Colorado, hereinafter <br />called the "District", and THE MODEL LAND AND IRRIGATION CO., <br />a mutual ditch company organized and existing under the laws <br /> <br />of the State of Colorado, hereinafter called the "Company", <br /> <br />WITNESSETH: <br /> <br />WHEREAS, the United States of America, acting through <br />the Corps of Engineers, the Department of the Army, proposes <br />under the provisions of the Flood Control Act of 1958 (PL .85-500 <br />.~2 Stat. 297) as amended by Public Law 89-298, 1965 (79 Stat. <br />1079) and House Document No. 325, 84th Congress, Second <br /> <br />. <br />.. <br /> <br />Session, to construct and operate the Trinidad Dam and Reser- <br />voir Project (hereinafter called "Project"), a multiple pur- <br />pose project which will provide flood control, irrigation, <br />recreation and fish and wildlife benefits within the District <br /> <br />and Las Animas County; and <br />WHEREAS, under the requirements of said House Document <br />No. 325, construction of the Project may not commence until a <br />repayment contract between the United states of America, (here- <br />inafter called the United states) and the District shall have <br /> <br />been executed which provides for the regulation and distribution <br /> <br />of the waters of the Purgatoire River through the operation of <br />the Project, and th~ repayment by the District to the United <br />States of the irrigation first cost of the Project (pre- <br />sently estimated at $6,435,600.00) together with the annual <br /> <br />ATTACHMENT 8 <br /> <br />------- <br />
