<br />application with the United States refereed to herein, fore- <br /> <br />closing the interest of such delinquent in and to the land, <br />water rights or appurtenences aescribed in any such contract <br />I <br /> <br />or subscription to the Associ~tion or contract or water right <br />i <br />application with the United states as aforesaid and against <br /> <br />which there shall be such ind~btedness, levy or asseSSlnent includ- <br /> <br />ing assessments for deficits ,due to the failure of some stock- <br /> <br />holders, water users, land o\voers, water right applicants or <br /> <br />contract holders to pay when due assessments levied upon their <br /> <br />shares of stock or against their lands. <br /> <br />Section 6. Failure to satisfy judgment. <br /> <br />In any suit so brought to foreclose the lanq, water rights <br /> <br />and/or appurtenances aforesaid, the Association shall be per- <br /> <br />mitted as against said property of any delinquent shareholder <br /> <br />to obtain judgment for all sums, indebtedness, levies or <br /> <br />. <br />assessments then due ~d in default under said contract dated <br /> <br />January 4, 1928 or under any other contract between the United <br /> <br />States and the Association or under any subscription for stock <br /> <br />to the Association or under any contract or water right applica- <br /> <br />tion with the United States o~ under any other instrument in <br /> <br />writine either to the Association or the United States, <br /> <br />together with all penalties and interest and a reasonable <br /> <br />attorney's fee incurred ~y the Association in any such fore- <br /> <br />closure suit. Upon the failure of the delinquent or anyone for <br /> <br />him to pay and satisfy said judgment immediately after the <br /> <br />rendition thereof, the land against which said sum, indebtedness, <br /> <br />levy or assessment is or will be a lien shallre sold by the <br /> <br />sheriff of the County in which said land is located, to satisfy <br /> <br />said judgment and if tbqreafter within the time provided by the <br /> <br /> <br />laws of the State of Colorado for the redemption of lands from <br /> <br />sale under judgment after the issuance of the sheriff's cert- <br /> <br />ificate of purchase on said l~nd, water ri~ht or appurtenances, <br /> <br />the delinquent or any other party authorized SO to do as pro- <br /> <br />vided by the Statutes of the State of Colorado pertaining to <br /> <br />-11- <br />
