CONTRACT, made this � day of ��G� 2000, by and <br />between the State of Colorado for the use and benefit of the De rtment of Natural Resources, <br />Colorado Water Conservation Board (CWCB), hereinafter referred to as the STATE, the Grand <br />Valley Water Users Association (ASSOCIATION or CONTRACTOR), and The United States Bureau <br />of Reclamation (Reclamation), hereinafter collectively referred to as the Parties. <br />FACTUAL RECITALS <br />A. Authority exists in state law, and state funds have been budgeted, appropriated and <br />otherwise made available and a sufficient unencumbered balance thereof remains available for <br />payment in Fund Number 424, Organization YYYY, Appropriation FWA, GBL GVWM, <br />Program WTRC, Object Code 5140, Reporting Category 0002, Contract Encumbrance <br />Number C150002. <br />B. Required approval, clearance, and coordination have been accomplished from and with <br />appropriate agencies. <br />C. Reclamation is authorized to cooperate in this contract pursuant to the Reclamation Act <br />of June 17, 1902 (32 Stat. 388) and all amendatory and supplemental acts, especially the Fish <br />and Wildtife Coordination Act of August 14, 1946 (48 S��t. 401), the Act of April 11, 1956 (70 <br />Stat. 105), and the Act of December 28, 1973 (87 Stat. 884). <br />D. The purpose of this contract is to provide a process for payment of public funds to be <br />used exclusively for costs incurred by the AssociATiotv in connection with the operation, <br />maintenance and replacement of the Grand Valley Water Management Improvements <br />("Improvements"). Reclamation will design and construct the Improvements and pay fo; the <br />costs of said design and construction. The Assoc�AT►oN and Reclamation will enter into a <br />separate agreement regarding the design, construction and installation of the Improvements and <br />Reclamation's cost-share. <br />E. The PARTiES have agreed to participate in the Improvements proposed as part of the <br />Recovery Implementation Program Recovery Action Plan (RIPRAP) of the Recovery <br />Implementaiion Program for the Endangered Fish Species of the Upper Colorado River Basin. <br />The Improvements consist of the installation, operation and maintenance of new "check <br />structures," modification of existing "check structures," automated gages and controls to operate <br />the Government Highline Canal (Canal) and check structures, a new turnout and pipeline on the <br />Page 1 of 11 <br />
