The application in this case was previously furnished to the <br />Conservation Board on January 23, 1996. <br /> <br />B. Eagle Park Reservoir Company <br /> <br />The draft articles of incorporation and bylaws of the Eagle Park Reservoir Company <br />are attached as Exhibits B-1 and B-2, respectively. These company formation documents should <br />be finalized within the next 60 days. <br /> <br />/ <br /> <br />C. Proiect Agreements. : y <br /> <br />1. The Letter of Intent dated April 30, 1996, among the loan applicants is attached \r \ / <br />as Exhibit C-l. This document sets forth the allocation of Project yield among these parties. <br /> <br />2. Attached as Exhibt C-2 is the Comprehensive Settlement Agreement dated ~ \)./ <br />April 30, 1996, among the Colorado River Water Conservation District, the Upper Eagle /' <br />Regional Water Authority, Vail Valley Consolidated Water District and Vail Associates. By this <br />agreement, the River District pledges the use of a portion of its Pando Feeder Canal water right <br />to enhance the yield of the Eagle Park Reservoir Project. <br /> <br />3. The Memorandum of Understanding dated July 8, 1996, between the Colorado -)u <br />River Water Conservation District and the Board of County Commissioners of Eagle County is ~\ <br />attached as Exhibit C-3. By this agreement, the River District has the right to acquire <br />approximately one-half of Eagle County's share of the Project yield. <br /> <br />4. The Eagle Park Reservoir Agreement dated October 23, 1996, among the Upper /t.u <br />Eagle Regional Water Authority and its member Districts is attached as Exhibit C-4. This V~ <br />agreement allocates the Authority's share of the Project yield among the member Districts of the <br />Authority and specifies the internal method of Project payment.
