Except for Parcel 3, the legal <br />descriptions on the attached Exhibit A are from the pending sale contracts for the land. No sale <br />contract has yet been signed for Parcel 3, but Model does intend to sell this land. Therefore, to <br />save the time of all parties, we are requesting release of Parcel 3 in advance. Model is not seeking <br />to sell Parcels 7 and 8 listed on the deed of trust Exhibit A because Parcel 8 is in the middle of the <br />Oxley Farm and Parcel 7 is Model's headgate on the Purgatory River. <br /> <br />In addition to the lands listed on attached Exhibit A, Model requests release of the two <br />water rights associated with the old Johns Flood Ditch as follows: <br /> <br />1. 1.25 cfs of the Lewelling-McCormick Ditch January 1, 1864, water right (Item 3 <br />on the water right listing of Exhibit A to the CWCB deed of trust). <br /> <br />2. 2.0 cfs of the Hoehne Ditch October 7, 1865, water right (Item 4 of the water <br />right listing of Exhibit A to the CWCB deed of trust). <br /> <br />47% of these water rights is being sold with Parcels 4 and 9, and 57% of these water rights is <br />being sold with Parcel 6. <br />
