'"\ <br /> <br />..... <br /> <br />are unable to convey irrigation water through the reservoir and there is no way to bypass water to ~ <br />the irrigated lands below the dam. ~j <br /> <br />In addition to the damages to Model Reservoir and to Model Ditch below the reservoir, there was <br />flooding downstream impacting a railroad embankment, another irrigation ditch, county roads <br />and two residences. The Division 2 Engineer's Office is concerned that another flood event this <br />year could result in further' erosion of the dam and more flooding downstream. <br /> <br />Project S{>onsor <br /> <br />The Model Land and Irrigation Company is a mutual ditch company incorporated in Colorado as <br />a nonprofit corporation. Currently there are seven shareholders in the Company with a total of <br />about 6,000 shares. Three shareholders own 1,988 shares each representing 99 % of the <br />ownership in the Company; they are the John T. Oxley Estate, the Thomas E. Oxley Trust and <br />the Mary Jane Tritsch Trust. Assets of the Company include the Model Ditch, the Model <br />Reservoir (a.k.a. Black Hills Reservoir) and associated water rights as well as about 2,600 acres <br />of crop and pastureland. <br /> <br />W ater Ri~hts <br /> <br />The Model Ditch has a 1908 absolute right for 200 cubic feet per second on the Purgatoire River <br />and Model Reservoir has a 1908 absolute right for 20,000 acre-feet from the Purgatoire River <br />and other sources. Both are adjudicated for agricultural and domestic purposes. <br /> <br />c> <br />."'.~' <br /> <br />The Model Reservoir storage right was transferred to Trinidad Reservoir in 1976 and the <br />Purgatoire River Water Conservancy District (PRWCD) manages the right pursuant to a contract <br />between the Company and the District. The Company's engineering consultant reports that <br />14,600 and 10,200 acre-feet were delivered to the Model Ditch by the PRWCD for the years <br />.1997 and 1998 respectively. <br /> <br />Pro{>osed Project . <br /> <br />The Model Land and Irrigation Company is proposing a tWo-phase project to remedy the <br />emergency situation as quickly as possible. All construction will be scheduled to take place this <br />srunmer. <br /> <br />The first phase, which is to begin in early June, involves the construction of a small temporary <br />dam and outlet pipe upstream of the existing dam to allow some flow of irrigation water through <br />the reservoir and to provide a degree of flood protection. The second phase, which will be <br />scheduled for sometime in July or early August, will involve replacing the existing outlet conduit <br />and outlet gate tower, repairs to the dam embankment and the installation of flumes to measure <br />releases from the reservoir. <br /> <br />In addition, the Division 2 Engineer has expressed concerns about the need for expansion of a <br />wasteway below the dam to allow local runoff to reach the Purgatoire River.
