Question. Won't Cooley's continued mining operations <br />interfere with the use of the site for a reservoir? <br /> <br />Answer. There are warranties in the Agreement providing <br />that Cooley will not ". . . damage or endanger the reservoir <br />structures or unreasonably obstruct, disrupt, or interfere with <br />the construction or operation of the reservoirs." (Agreement- <br />Paragraph 6.2) <br /> <br />14. Question. What is Cooley getting out of all of this? <br /> <br />Answer. First, Cooley is not getting the right to use <br />Morrison water except to the extent of three 3/4 inch water and <br />sewer taps (one each for the quarry, asphalt plant and concrete <br />plant if constructed) which we have agreed to provide on <br />specified terms and conditions, after the reservoir is completed. <br />(Agreement-Paragraph 7.0) Any other water Cooley may obtain will, <br />as it is today, be subject to the review and approval of the <br />Town. <br /> <br />Cooley is obtaining the right to mine an additional 39 acres and <br />to remine and reclaim an area already mined, both of which they <br />could have applied for in the County. Undoubtedly, Cooley sees <br />significant advantages to the annexation as of course does <br />Morrison, or else neither of us would be interested. <br /> <br />In summary, these are some of the questions that have been asked <br />and the above answers have been given.
