<br />e <br /> <br />b) The eDOW shall conduct the construction bid opening and award the <br />construction contract in consultation with the CWCB staff. <br /> <br />c) The CDOW shall provide the CWCB staff with copies of the Invitation to Bids, <br />Contractor's Proposal, Division of Wildlife General Requirements and Covenants for Capital <br />Construction, Final Plans, Construction Contract Documents, Construction Project Special <br />Provisions, and all change orders. <br /> <br />d) The CDOW and CWCB staffs shall conduct a pre-construction conference, to be <br />scheduled and conducted by CDOW, at which time they will review the construction schedule. <br /> <br />e) The CDOW shaIl designate a resident inspector in consultation with the eWCB <br /> <br />staff. <br /> <br />f) The CDOW shall construct the Facility in accordance with the final plans and <br />specifications, which may include modifications necessary to accommodate field conditions. <br /> <br />g) Upon completion of the Facility construction, the CDOW shaIl provide as-built <br />drawings to the CWCB staff and shaIl arrange a final inspection for the CWCB and CDOW <br />staffs, the construction firm, and the Consultant, which shaIl be conducted by the CDOW. <br /> <br />h) The primary contact person for the agencies regarding the design and <br />construction of the Facility shall be as follows: For CDOW - Ed Frazar (291-7400); for CWCB <br />_ Mike Serlet - 866-3441. The agencies may change their primary contacts by providing the <br />appropriate notice to the other agency. <br /> <br />e <br /> <br />4. Responsibility for Permits. The CDOW, the Consultant, and/or the Construction Firm(s) <br />shall be responsible for obtaining all necessary and applicable federal, state and local approvals and <br />permits for the construction and operation of the Facility. <br /> <br />5. Indemnification by Construction Firm(s). The CDOW shall require all Construction <br />Firms and their subcontractors to indemnify the CDOW and the CWCB against all liability and loss, and <br />against all claims and actions based upon or arising out of damage or injury, including death, to persons <br />or property, caused by any acts or omissions of those parties or sustained in connection with the <br />performance of any contract related to the Facility or by conditions created thereby, or based upon any <br />violation of any statute, ordinance, or regulation, and the defense of any such claims or actions. <br /> <br />6. Insurance During Construction. The CDOW shall require all Construction Firms and <br />their subcontractors, during the term of their contracts for construction of the Facility, to maintain the <br />foIlowing insurance. <br /> <br />a) Worker's compensation and employer's liability insurance in the required statutory <br />amounts. <br /> <br />b) Automobile liability insurance which includes coverage for all owned, non-owned and <br />hired vehicles with minimum limits of $1,000,000 combined single limit for bodily <br />injury and property damage. <br /> <br />c) <br /> <br />Commercial general liability insurance with minimum limits of $1,000,000 combined <br />single limit for each occurrence and $2,000,000 general aggregate.
