<br />DRAFT <br />9/22/95 <br /> <br />COLORADO WATER CONSERVATION BOARD <br />RECOVERY INSTREAM FLOW APPROPRIATION OPTIONS <br /> <br />Option II - Yarnpa River Instrearn Flow Appropriation <br /> <br />The following is one of several options which have been developed through extensive <br />consultations over the last year among representatives of the CWCB, State Engineer and Division <br />Engineers, Attorney General, Colorado River Water Conservation District, Colorado Water <br />Congress, U.S. Fish and Wildlife Service, and many other water interests for consideration by the <br />CWCB in late 1995 as a part of its efforts appropriate endangered fish recovery instream flows in <br />the Yampa River. <br /> <br />Concept <br /> <br />An instream flow right similar to the FWS flow recommendation less a development <br />allowance (Carve Out n is appropriated. <br /> <br />Runoff Months: 10% Exceedance; based on 19701992 adjusted flows <br />(CWCB Study) minus the monthly development allowance. <br />Non Runoff Months: 20 % Exceedance; based on 19501982 virgin flows (FWS <br />Study) minus the monthly development allowance. <br /> <br />A first development allowance (Carve Out I), distributed on a monthly basis, is remains <br />available for water rights junior to the ISF appropriation and is not included in the <br />appropriation, however both junior and senior rights may develop Carve Out I. <br /> <br />Monthly instream flow call triggers are developed for each month; when the flow at the <br />Maybell gage drops below the monthly instream flow call trigger, junior water right are <br />called out to meet the instream flow appropriation. <br /> <br />A second development allowance (Carve Out II) is provided for development in excess of <br />Carve Out I. <br /> <br />When the first development allowance (Carve Out I) is used up on either a monthly or <br />annual basis, the Board may modify the second development allowance (Carve Out I) <br />from instream flow uses to consumptive uses. <br /> <br />Option II-I <br />
