The <br />manager now reviews them from North Poudre's standpoint. <br />There was litigation in Larimer County Court when threats were made <br />relating to a North Poudre ditch right-of-way. A Restraining Order was entered <br />and no further problems have resulted. <br />Recreational leases on company reservoirs are now usually for three <br />years. Goals have been to have reasonable insurance coverage, to allow <br />recreation, and to try to be alert on safety matters. <br />As substantial growth in our popUlation continues, there are continuing <br />problems with subdivisions along ditches and reservoirs. The manager, for <br />example, has to watch for any interference with North Poudre's access to a <br />ditch and for storm drainage problems when a subdivision may route <br />drainage into a ditch. <br />Stock transfer requirements and obligations which must be met when <br />stock certificates are lost are a regular recurrence. <br />A District Court lawsuit is pending over one-half (1/2) share for which a lost <br />securities bond was given. In fact, the certificate was not lost and had been <br />sold but not surrendered to North Poudre for transfer. North Poudre denies <br />any liability. Several lenders are involved, and the high expenses, uncertainty <br />of litigation, and legal questions may contribute to a solution. <br />There has been a claim based upon seepage of a ditch, and it is being <br />investigated. <br />The existing security for loans with Colorado Water Conservation Board <br />(CWCB) was changed at CWCB's request to use Fossil Creek Reservoir. <br />Also, the sum of $1,107,000 was loaned for work or rehabilitation projects on <br />Reservoir No.4, Reservoir No.5, and Indian Creek at 4.04% per annum for <br />20 years. <br />The Conditional Water Decree for an enlarged Halligan Reservoir was <br />continued to April, 2007 by decree signed April 16, 2001 by Judge Hays.
