Box 1111, Sterling, <br />Colorado, 80751, Grantee, and DONALD SCHELL and KRISTIE M. SCHELL, 21957 CR 34, <br />Sterling, Colorado, RICHARD F. SCHELL and JUDITH K. SCHELL, 21886 CR 34, Sterling, <br />Colorado and JEROME H. SCHELL and ROSE MARIE SCHELL, 22920 CR 36.5, Sterling, <br />Colorado, Grantors. <br /> <br />1. The Low Line Ditch Company is seeking to build and maintain ponds for the purpose of <br />recharging water to the South Platte River. <br /> <br />2. The Grantors are the owners of the following described property; <br /> <br />Northwest 1/4 of Section 1, Township 8 North, Range 52 West of the 6th P.M. <br /> <br />3 . The Grantee desires to build and maintain a r~charge pond on the above described <br />. property an~ the Grantors consent to the use of its property for such purpose. <br /> <br />4. The Grantee and Grantors acknowledge that this agreement is part of a larger project <br />proposed by the Grantee. In the event that the entire project is unable to be completed or <br />becomes impractical to operate the Grantee is under no. obligation to continue the terms <br />and conditions of this Agreement It shall be the Grantee's sole discretion as to when the <br />entire project becomes impractical or obsolete. At such time, this Agreem~nt becomes <br />null and void, with no further obligations on the part of the Grantors or the Grantees. At <br />such time, any easements granted under this agreement shall revert back to the Grantors <br />or its heirs, successors and assigns. . <br /> <br />5. The Grantors grant to the Grantee an easement upon Grantors' property described above <br />for the purpose 'of constructing and maintaining a pond for the purpose of recharging <br />water. <br /> <br />'. 6. This Easement allows the Graritee the right to construct, operate and/or maintain: <br /> <br />a. A pond; <br />b. Any ditch, pipelin~ or other means necessary for the delivery of water to the pond; <br />c. Any headgate; . . <br />d. Diversion devices; <br />e. Measuring devices; <br />f. Monitoring wells; <br />g. Roads necessary for ingress and egress to maintain any and all structures <br />. associated withtlie pond; and/or <br />h. Any other structure or event necessary for the operation and maintenance of the <br />pond. <br /> <br />Attachment 4 to Conditional Assignment of Easements <br />
