Box 1111, Sterling, <br />Colorado, 80751, Grantee, and STEVEN J. KAISER and MICHELLE N. KAISER, 22811 CR <br />36, Sterling, Colorado,. Grantor.' . <br /> <br />1. The Low Line Ditch Company. is seeking to build and maintain ponds for the purpose of <br />recharging water to the South Platte River. <br /> <br />2. The Grantor is the owner of the following described property; <br /> <br />Southeast 1/4 of Section 2, Township 8 North, Range 52 West of the 611i P.M. <br /> <br />3. The Grantee desires to build and maintain a recharge pond on the above ,described <br />property and the Grantor consents to the use of its property for such purpose. <br /> <br />4. . The Grantee and Grantor acknowledge that this agreement is part of a larger project <br />proposed by the Grantee. In the event that the entire project is unable to be completed or <br />,becomes impractical to operate the Grantee is ,under no obligation to continue the tenns <br />and conditions of this Agreement. It shall be the Grantee's sole discretion as to when the <br />entire project.becomes impractical or obsolete. At such time, this Agreement becomes <br />null and void, with no ~er obligations on the part ofthe Grantor or the Grantee. At <br />such time, any easements. granted under this agreement shall revert back to the Grantor or <br />its heirs, successors and assigns. <br /> <br />5. ' The Grantor grants to the Grantee an easement upon Grantor's property described above <br />for the purpose of constructing' and maintaining a pond for the purpose of recharging <br />water. ' <br /> <br />6. This Easement allows the Grantee the right to construct, operate and/or maintain: <br /> <br />: <br /> <br />a. <br />b. <br /> <br />A pond; <br />. Any ditch, pipeli~e or other means necessary for the delivery of water to the pond; <br />Any headgate; .. <br />Diversion devices; <br />Measuring devices; <br />Monitoring wells; <br />Roads necessary for ingress and egress to maintain any and all structures <br />associated with,the pond; and/or . <br />Any other Structure' or event necessary for the operation and maintenance. of th.e <br />pond. <br /> <br />c. <br />d. <br />e. <br />f. <br />g; <br /> <br />h. <br /> <br />Attachm.ent 3 to Conditional Assignment of Easements <br />
