WHEREAS. required aplm",,!. clearance and coordination has been accomplished from and with appropriate
agencies: and

WHEREAS, pursuant to the provisions of section 37-60-119,
Colorado Revised Statutes. the State is authorized to loan
money for the construction of water projects for the benefit of
the people of the State; and

WHEREAS. pursuant to the provisions of section 37-60-120.
Colorado Revised Statutes. the state is authorized to take a
security interest in property or take~ndS' notes. or
other securities evidencing an ObI,. '0 will assure

WHEREAS. the Contractor is a ~~ ~~tuted water
conservancy district in the State ~~~~ado and wishes to
construct. or cause to be constru ed. the Stagecoach Dam and
Reservoir and associated site developments. hereinafter called
the project. at an estimated cost of Sixteen Million One
Hundred Thirty-Seven Thousand Dollars ($16.137.000); and

WHEREAS. a feasibility investigation of said project was
conducted and it was found that the project is technically and
financially feasible; and

WHEREAS. section 1(1){a) of chapter 405. Session Laws of
Colorado 1983. authorized the Colorado Water Conservation
Board. subject to the conditions set forth in section l{l}{d}
of the said act. to construct or cause to be constructed the
said project at a Board cost of Six Million Dollars
($6.000.000); and

WHEREAS. section l(l){b) of the said act provides that the
Colorado Water Conservation Board may expend on the project the
said amount of money plus or minus such amounts as may be
justified by reason of ordinary fluctuations in construction
costs as indicated by the engineering cost indices applicable
to the type of construction involved in the project; and

WHEREAS. the State has determined that the Six Million
Dollars ($6.000.000) can be increased. due to ordinary
fluctuations in construction costs as indicated by the
engineering cost indices applicable to this type of
construction. by Six Hundred Thousand Dollars ($600.000); and

WHEREAS. the conditions of subparagraphs (I). (II). and
(III) of section l(l)(d) of chapter 405. Session Laws of
Colorado 1983. have been met; and

WHEREAS. the site development plan required by subparagraph
(IV) of section 1(1)(d} of the said act was approved by the
Colorado General Assembly in section 11(1) of chapter 259.
