<br />(b) The expense of such operation and maintenance <br />activities shall be the sole responsibility of the <br />District. The Board shall not enter into a contract to <br />construct the project unless and until the District <br />agrees in that contract to assume the obligation for <br />operation and maintenance and unless the Board is <br />satisfied that sufficient monies will be available from <br />the District's ad valorum taxes, water sales, user <br /> <br />fees, or other <br /> <br /> <br /> <br />annual operation <br /> <br />(c) User fees may be the District or the <br />operating entity retained by the District for the use <br />of the pUblic facilities at the reservoir. <br /> <br />11. This site development plan does not presume to constitute <br /> <br /> <br />mitigation for such fish and wildlife impacts as the project <br /> <br /> <br />may cause. When mitigation requirements are determined, the <br /> <br />water surface area of the reservoir and the lands included <br /> <br /> <br />in this site development plan may be devoted to meeting such <br /> <br /> <br />mitigation requirements so long as the resulting uses are <br /> <br />consistent with the terms and conditions of this site <br /> <br /> <br />development plan. <br /> <br />gl <br /> <br />-8- <br />
