<br />Jul-09-01 01:42P Lower South Platte Water 970-522-0848 <br /> <br />P.02 <br /> <br />" <br /> <br />e <br /> <br />e <br /> <br />RESOLUTION <br />OF THE BOARD OF DIRECTORS OF THE <br />LOWER SOUTH PLATTE WATER CONSERVANCY DISTRICT <br />CONCERNING THE LOWER SOUTH PLATTE RECHARGE <br />PROJECT WATER ACTIVITY ENTERPRISE <br /> <br />WHEREAS, it is the desire of the Lower South Platte Water Conservancy <br />District to continue to operate the Lower South Platte Recharge Project as an <br />independent financial enterprise and to establish the Lower South Platte Recharge <br />Project as a water activity enterprise as its operation satisfies the terms of 937-45,1- <br />101, et seq., C. R. 8. <br /> <br />NOW, THEREFORE, BE IT RESOLVED, by the Board of Directors of the Lower <br />South Platte Water Conservancy District: <br /> <br />1. The Lower South Platte Water Conservancy District, being a conservancy <br />district created pursuant to 937-45-101, et. seq., C.R.S., hereby confirms the <br />establishment of the Lower South Platte Recharge Project as a "water activity <br />enterprise" pursuant to 937-45.1-101, et. seq., C.R.S., with all the powers and for <br />all the purposes granted by said article. <br /> <br />2. The Lower South Platte Recharge Project was established to reclaim, <br />conserve, recharge, augment, exchange and reuse water in addition to the other <br />purposes set out in 937-45.1-101(1) and 937-45-102(3), C.R.S. <br /> <br />3. The governing body of the Lower South Platte Recharge Project has been <br />and shall continue to be the Board of Directors of the Lower South Platte Water <br />Conservancy District. <br /> <br />4. The Board of Directors shall continue to !evy such assessments as <br />needed to operate the recharge project, obtain a substitute water supply plan, decree <br />a plan of augmentation and fulfill other purposes of the water activity enterprise as <br />defined in 937-45.1-101, et seq., C.R.S., without any levying any tax which is <br />subject to 920(4) of Article X of the Colorado Constitution. <br /> <br />5. The Lower South Platte Recharge Project may issue or reissue revenue <br />bonds, notes, or other obligations payable from the revenues to be derived from the <br />enterprise pursuant to ~ 37-45.1-104, C.R.
