District formed and governed pursuant to S 37-45..101, et seq" <br />C.R.S., and acting by and through its water and sewer enterprise. The Borrower <br />is an enterprise within the meaning of 937-45.1-101 et seq., C.R.S. and Article X, <br />Section 20 of the Colorado Constitution, created pursuant to Resolution of the <br />Lower South Platte Water Conservancy District dated May 11, 1993, which is <br />incorporated herein by reference. <br />Section 2 - Project Information <br />Description of Project: Construction of an augmentation well and groundwater <br />recharge ponds near the stateline at Julesburg. <br />Description of Feasibility Study: Jon Altenhofen, P.E., has completed a cost <br />estimate and a final draft feasibility study for the project. The study includes an <br />assessment of alternatives available to the District for augmentation of junior <br />wells. <br />Section 3 - Collateral <br />Collateral. Part of the security provided for this loan, shall be an undivided one hundred <br />percent interest in the following, hereinafter referred to as COLLATERAL: all revenues <br />derived from the BORROWER'S sale of replacement water from the PROJECT to the <br />Groundwater Appropriators of the South Platte River ("GASP") and/or, to any other <br />purchasers. The BORROWER has executed a Conditional Assignment of Contract <br />Proceeds, attached as APPENDIX 5 and incorporated herein, assigning the CWCB its right, <br />title and interest in and to the income from the sales of replacement water to GASP <br />pursuant to the BORROWER /GASP Agreement dated June 5, 2001, in the event of default <br />by the BORROWER under this contract. <br /> <br />Appendix 1 to Loan Contract C150067 <br />
