WHEREAS, required approval, clearance and coordination have been accomplished f m and with appropriate agencies; and

WHEREAS, the State and the Contractor entered into a contract dated
September 1, 1982, Contract Encumbrance Number C-153389, outing Number 83092
(hereinafter the "Original Contract"); and

WHEREAS, the Original Contract authorized the State t loan One Hundred
Twenty-Three Thousand Dollars ($123,000) to the Contractor f r the rehabilitation of
the Kern Reservoir Dam; and

WHEREAS, construction of this project was substantiall completed in 1984; and

WHEREAS, upon substantial comPletion~dect t e Contractor had only
borrowed Eighty Two Thousand Nine HundQ ven ars and Twenty-Three
Cents ($82,967.23) from the State for one haJ.o~. ....ctf ... ~li. dy cost and
approximately one half of the constructiO~~v.1~"'~ ; nd

WHEREAS, after substantial com~~f the project e Contractor did
indicate, in writing, that more work needed to be done and that additional State funds
would be required to complete the project; and
