Lochhead <br />Executive Director, DNR <br /> <br />Daries C. lile, f'E. <br />Director, CWCB <br /> <br />MEMORANDUM <br /> <br />To: Representative Entz <br />Senator Bishop <br /> <br />Prom: Peter Evans ~. <br />Bill Stanton vJ.~ <br /> <br />Date: March 28, 1997 <br /> <br />Re: Additional SB 97-008 Recommendation by the CWCB <br /> <br />On March 20, 1997, the Lower Arkansas Water Management Association <br />(LA WMA) requested the Colorado Water Conservation Board (CWCB) provide <br />additional loan funds in connection with LA WMA's need for augmentation supplies <br />required to meet the State Engineer's well pumping rules and the rulings in Kansas v <br />Colorado. Recent developments in the Kansas case will increase LA WMA's average <br />annual augmentation requirements. It is estimated that an additional supply of <br />approximately 4,200 acre-feet will be needed to meet the more stringent requirements. <br /> <br />LA WMA has only recently found an additional water supply in the Highland <br />Ditch on the lower Purgatoire River, and has adjusted its dues structure to increase its <br />creditworthiness. LA WMA needs additional loans in order to make these water rights <br />purchases. Therefore, LA WMA is seeking additional funding at this time. <br /> <br />There are at least two basic approaches that would provide loan funds necessary to <br />meet LA WMA's needs: <br /> <br />. add a new section to SB 97-008 that authorizes and directs the transfer of an <br />additional $2 million unreserved cash in the CWCB Construction Fund into <br />the Arkansas River Augmentation Loan Account (an account within the <br />Construction Fund itself); or <br /> <br />. add a new section authorizing a loan specifically for LA WMA. <br />
