<br />~; <br /> <br />(b) In addition to the above and foregoing <br />remedy, no water shall be delivered to any stockholder who is delin- <br />quent in assessments from and after June 1st of any year until all of <br />such assessments have been'fully paid and it shall be the duty of the <br />Secretary to certify to the Superintendent a written list of all <br />delinquent stockholders on JW10 1st of each year and said Superin- <br />tendent shall witllhold the delivery of water to such stockholder <br />or stockholders W1til said assessments have been fully paid. <br /> <br />ARTICLE X. <br /> <br />SUPERINTENDENT. <br /> <br />Section 1. The Superintendent shall receive compensation <br />only while on duty for the Company, s~ch compensation to be agr5ed <br />upon by the Board of Directors. He shall render monthly report to <br />the Secretary, in writing; such report shall show every person who <br />has worked on the Company's property and the amount due such person, <br />and the failure so to report shall work a forfeiture of the position <br />and pay of the S~perintendent. The Superintendent shall issue state- <br />ments to everyone doing work upon demand therefor, stating the time of <br />such work and the amount due therefor, and the Superintendent shall <br />sign the same. <br /> <br />Section 2. The Superintendent shall only have control of the <br />distribution of the water, control of the headgates and measuring boxes <br />of the Company'S system. <br /> <br />Section 3. Should the Board of Directors find it necessary <br />during the irrigation season, to employ an assistant to the Superin- <br />tendent, they may do so and fix his salary and the time he shall be <br />employed by the Company. 'rhe Assistant shall be governed 'by the <br />same rules as the Superintendant and his work assigned him by the <br />Superintendent, with the consent of the Board of Directors. <br /> <br />ARTICLE XI. <br /> <br />OF CONVEYING WAT~R FROM RESERVOIRS AND <br /> <br />DITCHES. <br /> <br />Section 1. The Company shall control all measuring boxes <br />and headgates under their system from the reservoirs to the last <br />dividing box. These measuring boxes and headgates shall be W1der the <br />control of the Superintendent and the Board of Directors who shall from <br />time to time see that they are properly adjusted to give each s tock- <br />holder the amount of water his stock calls for. <br /> <br />Section 2. Any stockholder or other person or persons found <br />tampering with any'headgate or measuring box for the purpose of in- <br />creasing or decreasing the flow or water in any private ditch, either <br />his own or other persons, or for any other purpose after the same has <br />been adjusted by the Superintendent or by an order of the Board of <br />Directors, shall be reported to the President of the Company, and upon <br />satisfactory proof being presented, it shall be the duty of the President <br />to at once take such legal steps as may be necessary to remedy the <br />situation. wnen any suit has been instituted no compromise or settle- <br />ment other than that made by the Courts shall be made, except by the <br />order of the majority of the Board of Directors. <br /> <br />6 <br />
