"

completion of the work. For purposes of the letter, I suggest that it would be appropriate
to include a timeline for the following key events:

1. Contract with an engineering firm to complete the final design of the needed
improvements. Start November 1999 and complete contract by end of December
1999.

2. Complete the design. Allow approximately 120 days to complete the design.

3. Obtain State Engineer's review of improvements. Once the design is complete it
is submitted to the State for permitting. Depending on the State's workload this
can take anywhere from 6-weeks up to about four months.

4. Advertise for construction contract. Usually this is not started until the State has
approved the design and construction documents. Allow a minimum of six
weeks.

5. Award a construction contract. After bids are received and reviewed the City can
enter into a contract for construction. This process usually takes about one
month.

6. Complete construction. We believe that the work can be completed in one full
construction season. Allow 180 days.

It is my understanding that Mr. Green should receive the letter as soon as possible, but
not later than Wednesday of next week. I strongly suggest the City contact Mr. Green at
(303) 866-3441 to further discuss the letter requirements. I also suggest that a copy of
the letter be sent to the State Engineer's office to inform them of the City's intention with
respect to addressing the dam's deficiencies.

Please do not hesitate to call if you need further information. As soon as comments are
received on the draft financial program, I can finish that work. It would be good to
address any additional needs with Mr. Green. Finally, with respect to the design of the
project, ICON Engineering remains committed to the City of Victor and we are well
qualified to complete the work necessary to produce the state approval of the construction
documents.

Sincerely,
ICON Engineering, Inc.

~ $JdtJ~

Penn Gildersleeve, PE
President

cc: Bill Green - Colorado Water Conservation Board
