Inc. <br /> <br />Dear Val: <br /> <br />Earlier, I had spoken to you as to a plan by which all of the parties may survive the above <br />action and accomplish most, if not, all of their original goals. The proposed plan is not perfect <br />and it will require sacrifice and compromise by each party but I feel that the goal will <br />substantiate the cost. <br /> <br />On the attached pages, you will see the details of the proposal. It is predicated on three key <br />points, namely (1) that RMI will agree to complete the job for the amount stated; (2) PMRCA <br />will raise the funds required prior to commencement of work by RMI, and; (3) Colorado Water <br />Conservation Board understands the necessity for an increase in the approved loan amount and <br />agrees. <br /> <br />In the exhibit to the attached proposal we have endeavored to show both phase I and phase II <br />agreements as well as payments to date. If there is something not shown accurately, please <br />address it to my attention. Some items, such as gross receipts tax, are not included <br />intentionally. As I mentioned above, this proposal is not perfect and does require sacrifice. <br />. ~~~t2~ <br />Finally, the scheduled special master hearing is set fo!:J!fa t.4:th. I suggest that we continue <br />this hearing one more time with the anticipation that the matter can be settled without the need <br />for the additional cost.
