<br />183818 11/12/1999 02:04P B: 368 P: 46 <br />Debbie Livengood-Custer County Clerk Colorado <br /> <br />hundred (400) acre-feet of Minimum Pool Water in the reservoir, unless the total storage <br />capacity of the Reservoir has been reduced below this amount by order ofthe State Engineer. <br /> <br />4,1 In the event the State designates a permanent use of a portion of the Minimum Pool space <br />for storage of State Water, then DeWeese shall only be obligated to replace evaporation pursuant <br />to paragraph 7 below from that amount of the minimum pool not designated for storage of "State <br />Water." For instance, if the state permanently designates one hundred (100) acre- feet ofthe <br />minimum pool for storage of StateW ater then DeWeese would replace evaporation from a <br />Minimum Pool of four hundred (400) acre-feet in size. A designation of permanent use of <br />Minimum Pool space shall be subject toan annual administrative charge as provided in <br />paragraph 12. below. <br /> <br />4.2 In the event, the State designates a temporary use of a portion of the minimum pool space <br />for storage ofStateWatei,then DeWeese shall be obligated to replace evaporation pursuant to <br />paragraph 7. below on the reduced amount of minimum pool water until such time as the State <br />refills the minimum pool space used to temporarily store State Water. For instance, if the State <br />designat~s one hundred (100) acre-feet of minimum pool space for temporary storage of State <br />Water, then DeWeese would only need to replace evaporation on a four hundred (400) acre foot <br />minimum pool until such time as the State refills the one hundred (100) acre-feet of temporary <br />storage space, bringing the storage amount in the minimum pool back up to five hundred (500) <br />acre-feet. A designation of temporary use of minimum pool space shall not exceed 10 <br />consecutive years and shall be subject to an annual administrative charge as provided in <br />paragraph 12. below during those years State Water is stored and released. <br /> <br />5. DeWeese shall promptly release some or all of the State Water from the Reservoir upon <br />the request of the State or persons designated by the State to exercise such authority, for example <br />the Division Engineer. <br /> <br />6, The displacement of Minimum Pool Water by State Water shall be in either the physical <br />sense or the accounting sense, depending on the availability of additional storage space <br />elsewhere in the Reservoir. <br /> <br />A. If the entire Reservoir is full, then the displacement shall be in the physical sense <br />and the displaced Minimum Pool Water shall be released downstream. <br /> <br />3 <br />
