.� - � <br />;5 �c�°'�e��' <br />o+� by � <br />,� d a° r� <br />���� �e <br />RE30LIITION 1993 - 11 <br />RESOLUTION ESTABLISHING A PARKER SEWER ENTERPRISE PURSUANT TO THE <br />PROVISIONS OF ARTICLE X, SECTION 20(2)(d) OF THE CONSTITUTION OF <br />THE STATE OF COLORADO. <br />WHEREAS, the electors of the State of Colorado did, on <br />November 3, 1992, adopt an amendment to the Colorado Constitution <br />known as the Taxpayer's Bill of Rights, which Amendment is now a <br />part of the Colorado Constitution at Article X, Section 20 thereof; <br />WHEREAS, Subpart (2)(d) of said Article X, Section 20 defines <br />an "enterprise" as.". .. a government-owned business authorized <br />to issue its own revenue bonds and receiving under 10� of annual <br />revenue in grants from all Colorado state and local governments <br />combined"; <br />WHEREAS, Subpart (2)(b) of said Article X, Section 20 excludes <br />enterprises from the definition of "district"; <br />WHEREAS, pursuant to the terms of Article X, Section 20 of the <br />Colorado Constitution, only districts are subject to the remaining <br />provisions of Article X, Section 20, with enterprises being <br />expressly excluded therefrom; <br />WHEREAS, the Parker Water and Sanitation District has operated <br />the sewer function of the District's operations as an enterprise <br />in the past, and wishes to hereby formalize that means of operation <br />into the future so as to be in compliance with, and not in an <br />attempt to circumvent, the provisions of Article X, Section 20 of <br />the Colorado Constitution, and/or Article 45.1 of Title 37, C.R.S. <br />as enacted into law by SB 93-130; <br />WHEREAS, the Board of Directors of the Parker Water and <br />Sanitation District wish to delegate, assign and otherwise convey <br />the authority to the newly created Parker Sewer Enterprise <br />sufficient to allow the Parker Sewer Enterprise to meet all <br />constitutional requirements to be considered an enterprise. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE <br />PARKER WATER AND SANITATION DISTRICT, DOUGLAS COUNTY, COLORADO, AS <br />FOLLOWS: <br />Section 1. There is hereby created the Parker Sewer <br />Enterprise, which is authorized and directed to operate as a <br />business, with the assets thereof to be owned by the Parker Water <br />and Sanitation District. The business of the Sewer Enterprise <br />shall be real and personal property acquisition and development to <br />allow treatment plant construction, aperation, repair and <br />maintenance, and the proper and lawful treatment and disposal of <br />effluent. <br />
