� �� ► � - � ` Ce r�e • , U � �� Ce �e c � 'Cr`5 ar � �� RE30LIITION 1993 - 10 A RESOLUTION ESTABLISHING A PARKER WATER ENTERPRISE PURSUANT TO THE PROVISIONS OF ARTICLE X, SECTION 20(2)(d) OF THE CONSTITUTION OF THE STATE OF COLORP,DO. WHEREAS, the electors of the State of Colorado did, on November 3, 1992, adopt an amendment to the Colorado Constitution known as the Taxpayer's Bill of Rights, which Aznendment is now a part of the Colorado Constitution at Article X, Section 20 thereof; WHEREAS, Subpart (2)(d) of said Article X, Section 20 defines an "enterprise" as " . a government-owned business authorized to issue its own revenue bonds and receiving under 10� of annual revenue �in grants from all Colorado state and local governments combined , WHEREAS, Subpart (2)(b) of said Article X, Section 20 excludes enterprises from the definition of "district"; � WHEREAS, pursuant to the terms of Article X, Section 20 of the Colorado Constitution, only districts are subject to the remaining provisions of Article X, Section 20, with enterprises being expressly excluded therefrom; WHEREAS, the Parker Water and Sanitation District has operated the water function of the District's operations as an enterprise in the past, and wishes to hereby formalize that means of operation into the future so as to be in compliance with, and not in an attempt to circumvent, the provisions of Article X, Section 20 of the Colorado Constitution, and/or Article 45.1 of Title 37, C.R.S. as enacted into law by SB 93-130; WHEREAS, the Board of Directors of the Parker Water and Sanitation District wish to delegate, assign and otherwise convey the authority to the newly created Parker Water Enterprise sufficient to allow the Parker Water Enterprise to n�eet all constitutional requirements to be considered an enterprise. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE PARKER WATER AND SANITATION DISTRICT, DOUGLAS COUNTY, COLORADO, AS FOLLOWS: Section 1. There is hereby created the Parker Water Enterprise, which is authorized and directed to operate as a business, with the assets thereof to be owned by the Parker Water and Sanitation District. The business of the Water Enterprise shall be to acquire water and water rights, develop water and water rights, to treat water, and to deliver water and water services to customers of the Parker Water and Sanitation District.
