NON-IRItIGATION COVENANT
This Covenant is made this day of . 2004, between James
Ho�e 8� R�che, LLC (herein�fter refened to as "Grantor") and 3T Cattle Company, Inc. whose address is
3T Cattle Company; Inc., P.O. Box 88, Fort Morgan, CO: 80701(hereinafter referred to as "Grarnee").
WITNESSETH:
1. Grantor, for Ten Dollars (�10.00) and other good and.valuable consideration, the receipt
and sufficiency of which is hereby aeknowledged, does �ehy represent that he is the awner af
acres of land more or less ("Land"), described in Exhibit A attached hereto that was historically imgated
with 5 shares of eapital stoek in the Welc�on Valley Ditch Company, wtuch are bein� purchased by
Gramee. Grantor covenants that he has the right and privilege to execute this Govena.nt and that
acres of said Land will be removed from irrigation and shall not be irrigated in the future except with vrrater
from an exempt well, water supplied by a municipal or quasi-municipal entity, or water diverted pursuant
to a decree from the Water Court for Water Division No. 1 obtained in a fixture cha.nge of water right
proceeding.
�. This Covenant shall be biding upon Grantor, his heirs, successors, and assigns and is to
run with the Land, for the benefit of Grantee, his successors, and assigns.
3. T}us Covenanf shall be recorded in the Clerk and Recorder's Office of Morgan County,
Colorado.
