<br /> KANSAS V. COLORADO LITIGATION SUPPORT
<br />Attorney General Request:
<br />Attorney General Ken Salazar, letter dated March 4, 2004, requested $750,000 over 3 fiscal ye ars ending
<br />June 30, 2007, to "implement findings in the Fourth Report of Special Master Arthur Litlleworth ...
<br />including future compliance issues pursuant to the Court's retained jurisdiction." A subsequent letter
<br />dated May 6, 2004, was sent to the Controller for the Department of Natural Resources, furthe r explaining
<br />the request and Board action.
<br />Colorado Water Conservation Board Action:
<br />At its March 16, 2004 regular meeting the Board reviewed the AG's request and supporting ma erials
<br />provided by the State Engineer and the CWCB staff. The Board "authorized an expenditure of up to
<br />$750,000 ... to defend and protect Colorado's allocations of water in interstate streams and rive rs ... to be
<br />used for the four activities ... in the supporting information." The Board also added a request that all
<br />participants seek alternate sources of funding for both the initial activities as well as ongoing op eration
<br />and maintenance.

<br />Project Status:
<br />First Iysimeter has been installed at CSU Experiment Station, Rocky Ford. Irrigation delivery to the
<br />Iysimeter successfully accomplished, Initial crop will be planted spring 2007, with crop use
<br />measurements during 2007 growing season. Cost savings and other funding sources will be us ed to
<br />begin construction of 2nd Iysimeter in 2007, Third year of field data on irrigation water use and efficiency
<br />has been collected and is being analyzed, and a concluding report will be prepared in the sprin~ of 2007,
<br />
<br />Six weather stations have been installed or refurbished in the Arkansas Valley and data collectitn has
<br />begun to support improved crop water use determinations. Weather network is receiving appro~riate
<br />maintenance to meet quality assurance needs, Expert witnesses have developed and reviewe
<br />refinements to HI Model and participated in arbitration process as required, No alternate fundin sources
<br />have been obtained yet, but inquiries have been made to the USDA, Colorado Congressional s~aff, and
<br />local water user organizations and groups, including the Arkansas Basin Roundtable (HB 1177)1 CSU
<br />has provided significant in kind contributions to the project, including a site for the Iysimeter and I reject
<br />management services, The DWR has also provided funds and design services.
